PRIVACY POLICY

The website https://fancode.com/shop (“Platform”) is owned and operated by Sporta Technologies Private Ltd (“Company”), a company incorporated under the laws of India and having its registered office at Unit No. 1201-1202, 12th Floor, Wing A, One BKC, G Block, Plot No.66, Bandra Kurla Complex, Bandra East, Mumbai, Maharashtra 400051, India. Through the Platform, the Company seeks to facilitate the listing, exhibition and offering for sale by vendors of certain merchandise (“Products”) to users of the Platform (“Users”).

The terms ‘Company’ or ‘us’ or ‘we’ or ’our’ refer to the owners of the Platform. The terms ‘you’ or ‘user’, and all its grammatical variations, refer to the user or viewer of the Platform.

This Privacy Policy (“Policy”) reflects the Company’s commitment towards protecting the privacy and personal information provided by Users and sets out the nature and type of information the Company collects from Users for the purpose of sale the Products, the usage and disclosure of such information, and the safety and security measures adopted by the Company to safeguard such information.

Please note that this Policy is only applicable to Users and the information and data gathered on or through the Platform and not to any other information or website. You are hereby advised to read this Policy carefully and fully understand the nature and purpose of gathering and/or collecting sensitive, personal and other information and the usage, disclosure and sharing of such information. By requesting and consenting to purchase the Products, you hereby also consent to the Company sharing information with third party vendors and service providers engaged by the Company as set out below and to the transfer and/or storage of user information and data across borders.

The Company also believes that the internet is an ever-evolving medium. We may periodically review from time to time and change this Policy to incorporate such future changes as may be considered appropriate. Any changes to our Policy will be posted on this page, so you are always aware of what information we collect, how we use it, how we store it and under what circumstances we disclose it.

Terms not defined herein will have the meaning ascribed to them in the Company’s Terms      of Use for the Platform.

Purpose and Usage:

This Policy explains:

  1.      The information we may collect about you through the Platform
  2.      The use and role of cookies and similar technologies on our Platform
  3.      How we will protect and use information we collect about and from you
  4.      The circumstances in which we might disclose your details to anyone else
  5.      When we may use your details to contact you
  6.      How you can be sure that the information we hold about you is accurate and current

Information Gathered

In general, you can visit our Platform without purchasing the Products or revealing your identity or any personal information about yourself. However, you may not be able to access significant portions and sections of the Platform or purchase the Products unless you login using your existing Platform credentials or create a new account to register on the Platform.

Information that we collect from you at registration or at any other time will vary depending upon the activity you seek to engage in, and in this respect, if you choose to sign up, we shall, at the first instance collect a username and email address from you. Further, if you are registered on the Platform as a User and wish to purchase the Products, as part of your profile on the Platform, you may be required to provide, inter alia, the following information: 

  •  Name
  •  Address
  •  Date Of Birth
  • Contact Details (including phone/mobile number)
  • Current Location/Address

In addition, we may collect demographic information such as information about your mobile device, computer, tablet, hardware, software, platform, media, Internet Protocol (IP) address and connection, information about online activity such as feature usage, click paths, and other data that you may provide in surveys or while completing your account profiles. We may use the demographic information and Personal Information in combination with each other or otherwise to tailor our offerings  and Products or web pages to your preferences or interests, to keep you informed of our Products and/or offerings and products and/or services of our affiliates and group entities and to enable our affiliates and group entities to reach out to you in relation to the products and/or services offered by them.     

Personal Information

Personal Information means any information that may be used to identify you and that is not otherwise publicly available, including, but not limited to, your first and last name, age, place of residence and an email address, phone number or other contact information. 

We may collect Personal Information from you when you register and create a profile on the Platform to view the Products, or otherwise voluntarily provide such information. Further, in the case of Users purchasing the Products, we may use such Personal Information in order to verify your credentials, to assist sellers in handling orders, for the purpose of contacting you in the course of facilitating the confirmation of your order, communication in relation to the order and facilitating the delivery of the Products.

We may use Personal Information and other information received and collected from you to facilitate the delivery of the Products you have requested, to facilitate communication with vendors in relation to Products that you are interested in, to enable you to access and update your profile on the Platform, or any part thereof, and to contact you upon your request and when otherwise necessary. We may also use Personal Information for auditing, research and analysis, and to operate and improve our Products. In certain circumstances, we may share aggregated non-personal information with third parties. When we use third parties to assist us in processing your Personal Information, we require that they comply with our Policy and any other appropriate confidentiality and security measures.                               

     

Sensitive Personal Information

Sensitive Personal Information (“SPI”) means such personal information which consists of information relating to your password and financial information (such as bank account details or credit card numbers).

Except for your account password and any SPI that you choose to provide as part of your profile, the Company does not collect any SPI in the course of providing the Products for sale. Any SPI collected by the Company shall not be disclosed to any third party without your express consent, save as otherwise set out in this Policy or the Terms of Use or as provided in a separate written agreement between the Company and you or as required by law. It is clarified that this condition shall not apply to publicly available information, including SPI, in relation to you on the Platform.

However, you acknowledge that in the course of providing the Products, the Company may receive SPI, either when you voluntarily choose to update your profile with information related to your identity, physical and physiological condition, or from such content posted by you on the Platform, and you hereby consent and agree to allow the Company to store and display the SPI collected in this manner on the Platform and disclose it in accordance with the terms of this Policy.

Disclosure/Sharing

The Company may also share information as provided by you and data concerning usage of the Platform with vendors who have listed Products on the Platform, as well as third party service providers engaged by the Company for the purpose of data analytics or for the purpose of storage improving the Products (including product enhancements) and to help      the Company serve you better.

By using the Platform, you hereby expressly agree and grant consent to the collection, use and storage of Personal Information by the Company. You agree that the Company may share, disclose and transfer information received by you and collected and gathered hereunder by the Company, including information relating to your usage of the Platform, any analysis derived therefrom with its own affiliates, provided that affiliate, group entity and third party service provider (as may be applicable) with whom the information is shared will be required, on best efforts basis, to comply with the same standards as applicable to Company in relation to maintaining the security of the information.

In the event the Company sells or transfers all or a portion of its business assets, consumer information may be one of the business assets that are shared, disclosed or transferred as part of the transaction. You hereby expressly grant consent and permission to the Company for disclosure and transfer of such information to such third parties. Further, the Company reserves the right to share and/or disclose your information  with its affiliates, group entities and third parties in limited circumstances, including for the purpose of complying with applicable law, responding to duly authorised legal process, governmental requests, preventing fraud or imminent harm and ensuring the security of our network and services.      

Cookies and Other Tracking Technologies

Some of our web pages may also utilise “cookies” and other tracking technologies or tools. A “cookie” is a small text file that may be used, for example, to collect information about your activity on our Platform. Some cookies and other technologies may serve to recall Personal Information previously indicated by you. Most browsers allow you to control cookies, including whether or not to accept them and how to remove them. You may set most browsers to notify you if you receive a cookie, or you may choose to block cookies with your browser, but please note that if you choose to erase or block your cookies, you may need to re-enter your Personal Information to gain access to certain parts of our Platform.

Tracking technologies may automatically record information such as Internet domain and host names; other information about your geographic location; IP addresses; browser software and operating system types; CPU/mobile type; your manner of connecting to the Internet (e.g., connection speed through narrowband or broadband access); click paths; and dates and times that our Platform is accessed. Such information does not identify the User personally.

Our use of cookies and other tracking technologies allows us to improve our Platform and consequently your experience using the Platform and purchasing the Products. We may also analyse information that does not include Personal Information for trends and statistics.

Confidentiality and Security

We will keep confidential and protect your SPI and Personal Information except where disclosure is required or permitted by law or in instances where use and disclosure thereof is permitted under this Policy.

We follow generally accepted industry standards to protect the SPI and Personal Information submitted to us, both during transmission and, once we receive it, for storage and disposal. All information we gather is securely stored within databases controlled by us. The databases are stored on servers secured behind a firewall; access to the servers is password protected and is strictly limited. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your Personal Information and SPI, we cannot guarantee its absolute security.

We limit access to SPI and Personal Information to employees/personnel/vendors/service providers who we believe reasonably need to come into contact with that information to provide the Products to you or in order to do their jobs.

Third parties provide certain services and Products available on our Platform. We may provide information, including Personal Information, to third-party service providers and vendors to facilitate the sale and delivery of Products as well as to help us deliver information and services efficiently and effectively. Service providers are also an important means by which we maintain our Platform and mailing lists. We will take reasonable steps to ensure that these third-party service providers and vendors are obligated to protect Personal Information on our behalf through confidentiality agreements and otherwise. We do not intend to transfer SPI and Personal Information without your consent to third parties who are not bound to act on our behalf unless such transfer is legally required. Similarly, it is against our policy to sell SPI and Personal Information collected online without consent.

If you choose to provide us with your SPI and Personal Information, we may transfer that SPI and Personal Information from your country or jurisdiction to other countries or jurisdictions around the world. Your SPI and Personal Information may be collected and stored on servers located in the territory of India and such other countries as we may disclose from time to time. 

Third Party Platforms

If you click on a link to a third-party site or otherwise leave the Platform, you will go to a platform that is outside the purview of our control. Because we cannot control the activities of third parties, we cannot accept responsibility for any use of your Personal Information by such third parties, and we cannot guarantee that they will adhere to the same privacy and security practices as we do. The use of Personal Information by such platforms shall be governed by the privacy policies provided therein. Therefore, if you visit a third-party platform that is linked to our Platform, you should consult that platform's privacy policy before providing any Personal Information.

Advertising

When the Company presents information to its online advertisers -- to help them understand our audience and confirm the value of advertising on the Platform -- it is usually in the form of aggregated anonymised data (information that cannot be used to trace a user) of Users that may include  statistics and/or date concerning user traffic, user responsiveness, user behaviour to such advertisements on  our Platform. When you register on the Platform, we may contact you from time to time about updating your content to provide features which we believe may benefit you.     

Conditions of Use

THE COMPANY DOES NOT WARRANT THAT THIS PLATFORM, ITS SERVERS, OR EMAILS SENT BY US OR ON OUR BEHALF ARE VIRUS FREE. THE COMPANY WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS PLATFORM, INCLUDING, BUT NOT LIMITED TO COMPENSATORY, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL AND CONSEQUENTIAL DAMAGES, LOSS OF DATA, GOODWILL, BUSINESS OPPORTUNITY, INCOME OR PROFIT, LOSS OF OR DAMAGE TO PROPERTY AND CLAIMS OF THIRD PARTIES.

We may contact you using the Personal Information you have given us:

  • To facilitate any of your Product transactions on the Platform
  • In relation to ensuring that we can facilitate the delivery of the Products to you
  • Where you have opted to receive further correspondence
  • To invite you to participate in surveys, opinion polls, etc., about our services or otherwise (participation is always voluntary)
  • To provide you information about our new products and services, where you have specifically agreed to receive this.

Accuracy

To the extent that you do provide us with Personal Information and SPI, we encourage you to update and maintain accurate and current SPI and Personal Information provided by you to enable to provide services efficiently. Where we collect SPI and Personal Information from you on our Platform, should you need to update or correct that SPI and Personal Information, please contact us and we will make reasonable efforts to incorporate the changes in your SPI and Personal Information that we hold as soon as practicable. You can obtain the information we currently hold on you by emailing the Company at support@fancode.com from the email address provided to the Company at the time of registration on the Platform. 

Retention of Data          

Your Personal Information may be retained and may continue to be used until: (i) the relevant purposes for the use of your information described in this Policy are no longer applicable; and (ii) we are no longer required by applicable law, regulations, contractual obligations or legitimate business purposes to retain your Personal Information and the retention of your Personal Information is not required for the establishment, exercise or defense of any legal claim.

Applicable Law

This Policy and information contained herein, shall be governed by the laws of the Republic of India and the courts of Mumbai, India shall retain exclusive jurisdiction to entertain any proceedings in relation to any disputes arising out of the same.
